My WinStar Resort Mobile Application (the “App”), owned and operated by the Chickasaw Nation, a federally recognized sovereign and self-governing American Indian Nation, by and through its Department of Commerce (“Nation”) on behalf of WinStar World Casino & Resort (“WinStar”), knows you care how information about you is used and shared. We hope the following statements will help you understand how the App will collect, use and protect the information you provide to us on our site or app.

Consent

By providing personal information (such as your name, email address, account password, contact lists, unique device ID and location, and/or an image of you or owned by you) for purposes of using the App, you agree and accept that we may gather, process, store, and/or use the submitted personal information in accordance with this policy. You may withdraw your consent at any time and ask that we delete any personal information we may have at no cost or obligation to you. Examples of personal information we may collect are: first name, last name, mailing address, telephone number, email address, date of birth, travel dates, reservation details, important dates such as anniversaries, scanned images of passport, driver’s license or other government issues identification, special services, or amenities you’ve requested, your preferences.

What we collect and How we use it

Information you provide

When you sign up for the App account, or another Nation service or promotion that requires registration, we ask you for personal information, which may include your name, email address, and an account password. You may also choose to upload a photograph or other digital image or file for your profile, in which case, we will request your permission to access your device or cloud- based storage system, as the case may be. Please be careful, however, when uploading digital information to avoid any unintentional disclosure of personal or sensitive information concerning you or anyone else, as uploaded content may be viewable by others, depending on your account settings. We may combine the information you submit under your account, with information from other affiliates, services or third parties to provide you with a better experience and to improve the quality of our services. We may use the information we collect and receive to provide ads for our services, certain third-party services, and to send you promotional communications. For certain services, we may allow you to opt out of combining such information. If you use a “share with a friend” or “invite a friend” feature, we may collect your name and email address, as well as the name and email address of the recipient.

Unique Device ID and GPS location

When you access the App, we may collect your Unique Device ID (‘UDID’), device type, operating system, browser type, media access control (MAC) address, domain server, session time, bandwidth used, geolocation data and/or Wi-Fi information and/or IP address and/or GPS location. We use this information to provide a tailored experience for you. The information is collected in order to determine the aggregate number of unique devices using our service or parts of our service, to track total usage, analyze data, and communicate with you more effectively. We may combine this information with information from third parties to provide you with a better experience and to improve the quality of our service. We do not share any personally identifiable information with third parties in association with your UDID or GPS location without your explicit permission.

Contact list

Certain features in the App may ask you to provide your contact list email addresses. Your contact email addresses won’t leave your device. Matching is done in a way that prevents our servers from seeing the email addresses. We use this information to match you with other App users that you already know from your contact list and create a friend request in the app between you.

Log information

When you use the App, our servers automatically record information that your browser sends when you visit one of our websites. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser.

User communications

Personal information or requests that you submit via the App will be sent to the group administrator. The group administrator and/or one of their members will have access to this information. When you send email or other communication to any Nation owned website, we may retain those communications to process your inquiries, respond to your requests and improve our services.

Third party links

Please note that this Privacy Policy applies only to this App. Other websites, applications, or other services of the Nation or third parties, which may be linked, are governed by their respective separate Privacy Policies. The Nation cannot regulate other sites linked from within our various applications, web sites and services. These other sites may place their own cookies or other files on your computer or phone, collect data or solicit personal information from you. You should familiarize yourself with their unique Privacy Policies, should you choose to visit their sites.

How do we use your information?

When you sign up for a particular service that requires registration, we ask you to provide personal information. If the Nation would like to use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use. We provide information about you to service providers that perform certain functions or services on our behalf. We partner with third parties to operation some of our services and we may provide information about you to these operational partners. We share information you provide with select business partners, such as retailers so they can provide you with special offers, promotional materials and other materials or information that may be of interest to you. You may decline to submit personal information to any of our services, in which case we may not be able to provide those services to you.

How do we protect your information?

The Nation does not share your personal information with other institutions outside of the Nation, or its affiliates, without your explicit consent. Otherwise, the Nation may only share your personal information if it has a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms Of Use, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of the Nation, its users or the public as required or permitted by law. The Nation takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data, including internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. Unless explicit permission is obtained from you, the Nation restricts access to personal information to its employees, contractors and agents who need to know that information to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. By using our services, you understand and acknowledge that no system, or wireless network is impenetrable or 100% secure. Accordingly, we cannot guarantee or warrant that information you provide us would not be compromised in the event of a security breach. Data Integrity

The Nation reviews our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

Accessing and updating personal information

When you use any Nation service, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate service purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Some of our services have different procedures to access, correct or delete users’ personal information.

Changes to this Policy

We reserve the right to update this policy at any time and without notice. All changes will be effective as of the Effective Date at the top of this Policy.

Enforcement

The Nation periodically reviews its compliance with this Privacy Policy. When we receive formal written complaints regarding privacy issues, it is our policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between the Nation and an individual.
